Terms of Service
1. Acceptance of Terms
By accessing or using the Tourify platform ("Service"), operated by Tourify Technologies ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including free and paid plan users. If you are using the Service on behalf of a business or other entity, you represent that you have the authority to bind that entity to these Terms.
2. Description of Service
Tourify is a software-as-a-service (SaaS) platform designed for Indian tour operators. The Service provides tools for managing leads, bookings, traveller information, invoicing, itinerary creation, vendor management, document generation, a traveller portal, website builder, and other operational features. The specific features available to you depend on your subscription plan.
3. Account Registration & Security
To use the Service, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access or use of your account
- Keeping your account information up to date
We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
4. Subscription Plans & Billing
Plans
Tourify offers a free tier and multiple paid subscription plans. Each plan includes specific limits on features, storage, and usage. Plan details and pricing are available on our pricing page.
Billing
Paid plans are billed in Indian Rupees (INR) on a monthly or annual basis, depending on your selection. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring basis until you cancel.
Price Changes
We may change our prices with at least 30 days' prior notice. Price changes will take effect at the start of your next billing cycle. Your continued use of the Service after the price change constitutes your agreement to the new pricing.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Upload or transmit malicious code, viruses, or harmful content
- Attempt to gain unauthorised access to the Service or its infrastructure
- Interfere with or disrupt the Service or servers
- Use the Service for fraudulent, deceptive, or illegal activities
- Scrape, crawl, or harvest data from the Service without permission
- Resell, sublicense, or redistribute the Service without written consent
- Send spam or unsolicited communications through the Service
We reserve the right to suspend or terminate accounts that violate this policy, with or without prior notice.
6. Intellectual Property
The Service, including its design, code, features, logos, trademarks, and documentation, is owned by Tourify Technologies and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for the duration of your subscription.
You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless permitted by law.
7. User Content & Data Ownership
You retain full ownership of all data, content, and materials you upload, create, or store on the Service ("User Content"). We do not claim any ownership rights over your User Content.
By using the Service, you grant us a limited licence to host, store, process, and display your User Content solely for the purpose of providing the Service to you.
You may export your data at any time. Upon account termination, we will retain your data for 30 days to allow recovery, after which it will be permanently deleted unless required by law.
8. Service Availability & SLA
We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Planned maintenance (with reasonable advance notice)
- Emergency maintenance for security or stability
- Events beyond our reasonable control (force majeure)
For paid plans, we target 99.9% uptime on a monthly basis, excluding planned maintenance windows.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Service is provided "as is" and "as available" without warranties of any kind, express or implied
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability for any claim arising from or related to the Service shall not exceed the amount paid by you during the 12 months preceding the claim
- We are not liable for any loss of data, revenue, or business opportunities
10. Indemnification
You agree to indemnify, defend, and hold harmless Tourify Technologies, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your User Content.
11. Termination
Either party may terminate the agreement:
- By you: Cancel your subscription at any time from your account settings. Your access continues until the end of the current billing period
- By us: We may suspend or terminate your account for violation of these Terms, with or without notice depending on the severity of the violation
Upon termination, your data will be retained for 30 days to allow for export or recovery. After this period, all data will be permanently deleted. Sections of these Terms that by their nature should survive termination shall continue in effect.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
13. Dispute Resolution
In the event of a dispute, the parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, either party may initiate arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India).
The arbitration shall be conducted in English, with the seat of arbitration in Bengaluru, Karnataka. The decision of the arbitrator shall be final and binding on both parties.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and, where practicable, by email. Changes take effect 30 days after posting unless otherwise stated. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
