Schengen visa refused: appeal or reapply, and how to decide

A Schengen refusal letter carries a reason and a deadline. Here's how agents decide to appeal, refile fast, or wait a season, country by country.

Amalfi · 07:40

Your client's Schengen visa comes back refused, the group leaves in five weeks, and they want to know today: appeal, reapply, or cancel. In 2025, Schengen consulates in India did not issue 1,81,111 of 11,53,748 uniform visas applied for, about one in six, per the European Commission's own consulate-level data. Every refusal letter carries a ticked ground and a printed appeal route; read both against the departure date before you say anything.

Read the ground on the letter, not the number

A refused applicant must be told why the application was rejected and how to appeal (European Commission guidance). In practice that comes on a standard refusal form with the ground ticked (Swiss SEM). The numbers beside each ground in older letters and orders may not match your client's form, so read the words ticked, not a remembered number.

Indian commission records show what those words look like: "justification for the purpose and conditions of the intended stay was not provided", or "not reliable" (Kuoni Travel v Raj Kumar Aggarwal, 2015); failing to provide "sufficient means of subsistence...for the return to the country of origin" (Mohit Madan v MakeMyTrip, 2017); or "intention to leave the territory...could not be ascertained" (Dr Nirpaul Singh v Kalra Tour and Travel, 2017). German missions in India are blunt: "most rejections are the result of incomplete or unverifiable documentation" (page dated July 2025), so the usual answer is a better file, not an argument.

Fix, fight or wait: a decision table by refusal ground

Match the ticked ground to one of three moves.

Ground on the letter Best move Fresh file needs
Purpose, conditions of stay not provided Fix: refile, gap closed Full itinerary, matching purpose evidence
Not reliable; can trace to placeholder bookings Fix: verifiable bookings Real confirmations matching the cover letter
Sufficient means of subsistence not provided Fix if money's real; wait if not Applicant's and sponsor's 2-yr ITR and 3 months' statements (Spain's list); a note on any large deposit
Intention to leave not ascertained Fix if ties are real; wait if not Leave letter, return ticket, genuine ties
Travel medical insurance short Fix: easiest refile Compliant insurance for the full stay
Documents flagged false/doubtful Stop, don't refile same file Check exposure first

Fight, meaning appeal, only when the evidence was already in the file and plainly misread, and the trip can move. Whichever ground, the refusal doesn't disappear: VIS keeps it for five years (European Commission, VIS). A fresh file must answer the ground, not resubmit the same papers.

Appeal routes and deadlines by country

As of October 2026. Confirm against the exact route printed on your client's own letter.

Country Where and how Deadline, then what
France RAPO letter to the sous-directeur des visas (Service-Public.fr) 30 days; 2 months' silence = rejection, then 2 months to the Nantes tribunal
Germany Lawsuit at the Administrative Court Berlin, EUR 483 court fee upfront; or reapply any time, no wait (German Missions in India) 1 month to sue; remonstration abolished in India since 1 Jan 2024 (Schengen visa page)
Italy TAR Lazio, via a lawyer (Embassy of Italy) 60 days from service
Spain Reconsideration letter. Delhi: in person at the Consular Section, in Spanish or Spanish and English, no email or post (Embassy of Spain); Mumbai: at any BLS centre (Consulate General) 1 month; Delhi decides within 1 month max; 2 months to the Madrid High Court
Netherlands Free objection to the IND, in Dutch, English, German or French (IND) 4 weeks; IND says it can currently take 6 months
Switzerland Written objection to the SEM, Bern, in German, French or Italian (SEM FAQ) 30 days from receipt; then a CHF 200 advance, payable within 30 days

Other states: the route is on the letter itself. And an email asking a visa section to "reconsider" isn't an appeal: one mission's emailed reply on record says "the Visa Section of this Embassy is neither supposed to provide any further detail...nor reconsider the same" (More Than Travels v Vijay Kumar, Punjab SCDRC, 2023).

Worked example: refused with five weeks to go

Example: A family of four adults in Jaipur applies via BLS Delhi for an 8-night Spain-Portugal trip, 5 nights in Spain, so Spain is the main destination. The letter arrives 17 October 2026: means of subsistence not provided, sponsor's statements show a large deposit two weeks before filing, no ITR enclosed. Departure is 21 November, D-35. The visa fee paid per adult is ₹9,599 plus ₹1,802 BLS service charge, as shown 17 October 2026 (BLS Spain), so 4 x ₹11,401 = ₹45,604 is gone, non-refundable. Spain's reconsideration, lodged in person on Monday 19 October, can take up to a month, landing around 19 November, two days before departure, passports still to come back: not a plan for this trip. A fresh file lodged by 22 October (D-30), with 2 years of the sponsor's ITR, 3 months of statements and a note on the deposit, would get a normal 15-day decision around 6 November; a 45-day extension would slip past departure. Refile now if the money is real and documented; if it isn't, don't spend another ₹45,604 for the same answer, move the trip to a later season.

Refile at the same consulate, not a "softer" one

A refused file doesn't open a menu of consulates. Lodge at the consulate of the country you intend to visit, or for a multi-country trip, wherever you'll spend the longest time; equal stays go to the first country entered; the general rule is "territorial responsibility for the country where you are legally resident" (European Commission). Italy's New Delhi mission defines the main destination as where the applicant "intends to spend the longest time or where the main purpose of the intended journey is carried out" (Embassy of Italy).

France's 2025 not-issued rate at New Delhi was 27.4%, against 7.9% at Bangalore (European Commission, 2025 statistics); it's tempting to steer the file to the friendlier centre. Don't: the competent consulate is fixed by the itinerary and residence, not the refusal rate, and the earlier refusal is visible to any consulate checking VIS anyway. A Tamil Nadu commission has already billed an agency for getting this wrong: a coach tour whose longest Schengen stay was in France was filed at the Belgian consulate instead, failed the day before departure, and the agency was held negligent and ordered to reimburse the tour cost plus ₹25,000 compensation and ₹3,000 costs (Malar Travels & Tours v Ananth Suresh Prabhu, TN SCDRC, 2011).

Before any refile, record nights per country, the main purpose and the client's six-month residence (BLS Spain splits Delhi/Mumbai jurisdiction on exactly that: BLS Spain). A fresh file also needs a VAC slot; check the queue in the Europe group-tour slots playbook.

The reapplication cover note that answers each ground

A refile lives or dies on whether it answers the ticked ground in writing, before the officer reaches the enclosures.

REAPPLICATION COVER NOTE

To: Visa Section, [Consulate], [City] Date: [DD/MM/YYYY]
Applicant: [Name as in passport], Passport No. [number]
Earlier application: VAC ref [number], refused [DD/MM/YYYY]
Ground(s) stated (quoted exactly): "[paste the exact wording]"

Response per ground: [what was missing]. Enclosed [doc, numbered]
shows: [one line]. (Repeat if more than one ground was ticked.)

Itinerary: nights per Schengen country: [list]. [Country] is
competent because [longest stay / main purpose].
Ties to India: [leave letter/business proof], [return booking],
[family or property ties], each true and enclosed.

Enclosures: [numbered list]
Declaration: all information here and earlier is genuine to the
best of my knowledge. Signature: __________ Date: ______

Quote the ground word for word, never from memory; the base cover and sponsor letter formats are in visa letter formats. Never contradict the earlier file without saying why, or add a document the client can't produce if asked. If the ground is about forged or doubtful documents, this note is the wrong tool; check the agency's exposure first.

Tell the client the same day

Tell the client what the letter says the day it arrives. In a West Bengal case, the Schengen visa was refused on 19 May and the family heard only on 25 May, three days before the tour; the complaint said that left "no scope for re-submission". The agency, which had the documents two months before the tour, could not show when it had even applied, and the commission called that "a glaring example of negligence" (Club 7 Holidays v Ramesh Poddar, WB SCDRC, 2020).

Commissions don't all read the agent's role the same way. Where the visa sat inside a package and the grounds were purpose or reliability, one held the agency, not the client, had to explain them (Kuoni Travel v Raj Kumar Aggarwal, 2015); another, on a package tour, applied a National Commission ruling that a tour agency is not responsible for the rejection and "at the most" helps with the documentation (Thomas Cook India v Niravkumar Shah, 2024). Either way, give the client the ground, real dates and cost, the same day.

DAY-ONE WHATSAPP SCRIPT: VISA REFUSAL

[Client name], the consulate refused the Schengen visa. Reason given:
"[ground, quoted exactly]."

Options, real dates:
1. Fresh application by [date]; cost ~Rs [amount]; 15-day decision
around [date], can extend to 45.
2. Appeal by [deadline]; answer only after [date], so only works if
   we move the trip.
3. Move this trip to [later date]; refund/credit per our
   visa-refusal terms: [link].

Our recommendation: [option], because [one line why].
What we need from you by [date/time]: [documents or decision].

The land-package refund runs on your own terms; see what you refund after a visa refusal. If one traveller in a group is refused and the rest are cleared, say so in the same message.

Common questions

Schengen visa reject hone ke baad kitne din baad dobara apply kar sakte hain?

No fixed wait at the missions checked for this post. German missions in India say there is "no cooling / locking period" after a refusal (German Missions in India), and for a near-term trip the Netherlands advises a fresh application over waiting for an objection (NetherlandsWorldwide). File again once the ground is fixed.

Is the visa fee or VFS/BLS service charge refunded after a refusal?

No. BLS Spain's India page states the fee is non-refundable (BLS Spain), and the Netherlands says the same for its service providers (NetherlandsWorldwide). Budget a refile as a second full fee.

Can we apply through a different Schengen country that refuses fewer applicants, and does a refusal stay on record?

No to the first, and yes to the second. The competent consulate is fixed by the main destination and residence, not which one's refusal rate looks lower (European Commission); filing at the wrong consulate already cost one agency a negligence finding (see above). And VIS keeps the refusal for five years from the decision, open to the consulate examining the client's next application (European Commission, VIS).

The short version

  • Read the ground exactly as worded on the letter; don't trust a ground number from an old letter or order.
  • Document gaps (purpose, means, insurance) are usually fixable with a fresh file; profile or authenticity grounds mean wait, or stop and check the documents.
  • Check departure against the real deadline: France 30 days, Germany 1 month, Italy 60 days, Spain 1 month, Netherlands 4 weeks, Switzerland 30 days, as of October 2026.
  • Five weeks out, none of these appeal routes reliably answers before departure; a fast, corrected fresh file at the same consulate is usually the only route that can.
  • Refile at the same, competent consulate; main destination and residence decide it, not the refusal rate, and VIS keeps the refusal for five years.
  • Tell the client the ground, real dates and cost the same day; in one order, a refusal passed on six days late, with no record of when the file went in, was called negligence.
  • Expect visa fees and VAC charges to be lost on a refusal; any package refund runs on your own cancellation terms.
