No pickup at midnight: the 72-hour reconfirmation sweep

A voucher proves you booked it. A 72-hour reconfirmation sweep of hotels, transfers and handlers proves the room, car and driver will be there.

Amalfi · 07:40

For operators, a voucher is not proof the pickup will show up. Run a 72-hour reconfirmation sweep on every hotel, transfer and handler before your clients travel: a 2026 order shows what happens when nobody checked.

At Katra railway station, a 22-member pilgrim group arrived at 11:30 pm on 22 March 2025 for a Vaishno Devi and Kashmir tour. As reported, nobody from the agency was there, calls went unanswered, and the group paid for local logistics out of pocket and walked about 15 km to the shrine (LawTrend). Sixteen months later, the Alappuzha district consumer commission ordered the agency and its "business partners" to pay, jointly and severally, after the case went ex parte.

Why the seller pays when the handler doesn't show

In each order below, the commission billed the business that sold the trip and took the money, whoever actually failed on the ground. "Service" under the Consumer Protection Act, 2019 covers transport and "boarding or lodging", and "deficiency" includes any negligence or omission causing loss (section 2). The two older cases below ran under the 1986 Act it replaced.

Example: The Katra group paid ₹21,000 each, 22 x ₹21,000 = ₹4,62,000. The award, ₹4.98 lakh plus ₹3,000 costs (₹5.01 lakh), is about 108% of that. At a hypothetical 12% margin (₹55,440), one award like this wipes out the margin on about nine identical groups. The report doesn't itemise the award, so don't read it as the price of the pickup alone.

The Delhi State Consumer Commission, in Rose Tour and Travels (First Appeal 346/2023), upheld ₹3,50,000 against a ₹3,37,700 package (104%). A paid airport transfer in Kuala Lumpur didn't come, the vendor "citing non availability of driver beyond 8 p.m.", and later sightseeing pickups also failed (order, 15 Oct 2024). Alappuzha is press-reported and ex parte, not precedent, but it fits the same pattern. See how consumer courts decide cases against travel agencies.

The T-72 sweep: four things to confirm

72 hours out (a trade habit, not a legal rule), per booking:

  • The hotel's own confirmation number, from a call to the property, not off the portal or DMC voucher.
  • Payment status at the end of the chain: ask the hotel or vehicle owner, not the middleman, if it's actually paid. In one Delhi district case, the second hotel told the client a booking had been made but it hadn't received the money (LiveLaw on the 10 Oct 2025 order).
  • Driver name, mobile and vehicle number for every leg, plus the flight or train number given to the supplier.
  • The handler's full service list, read back against the client's itinerary, with a night contact who answers a test call.

Do this at T-72, not the evening before: in an NCDRC appeal by MakeMyTrip (First Appeal 236 of 2018), vouchers and hotel details reached the client only the evening before departure, hotels were changed without notice, and one Singapore hotel had no booking for him. The NCDRC upheld the finding of deficiency (order, 22 Jan 2024). RED gets fixed by T-48 or rebooked, client told now.

When the hotel says it has no booking from your portal

A portal or bed-bank voucher is the middleman's promise, not the hotel's. A tribunal order in an unrelated tax dispute lists four separate documents behind one online platform's hotel bookings: a booking voucher, a hotel confirmation voucher, a hotelier voucher and a hotel payment voucher (CESTAT, 5 Jun 2024). The client's voucher, the hotel's record and the hotel's payment are separate steps, and the Delhi district and NCDRC cases above show the last two can go missing.

The drill: call the hotel with the guest name and dates, ask for its own confirmation number, the reservation name, and whether it's prepaid or pay-at-hotel, by whom. No record: raise it with the portal in writing, same day, with a deadline, and rebook direct if unresolved by T-48. "No record" is one of three main reasons a consumer guide gives for hotels refusing check-in on a paid booking, as of October 2026 (righttoinformation.wiki). Book direct for single-night stops, late-night arrivals and peak dates.

The night-arrival rule

Arrivals between 21:00 and 06:00 get extra steps: this is where Rose Tour's transfer failed, a vendor that wouldn't send a driver "beyond 8 p.m." Get written confirmation a driver is on duty that hour, have the supplier track the flight or train, have the driver call on landing, and make sure your night number is actually answered (Katra: it wasn't). Add a fallback cab up to an agency-set cap, reimbursed against a receipt, if the driver is absent and unreachable past a set time. Recheck arrival at T-24; flight monitoring sits in flight time changed, client missed it: why courts bill the agent.

The T-24 client message

Send the hotel confirmation number, reservation name, the hotel's own phone number, and the driver's name, mobile and vehicle, so the client can verify independently, catching fraud too: a mid-October 2026 report describes an Ahmedabad agent who allegedly sent fake WhatsApp vouchers to 18 clients who had paid ₹12.03 lakh for a December 2025 Thailand trip and landed to no vehicle and no hotel booking (Gujarat Samachar). This slots into the pre-trip documents checklist you already WhatsApp clients; add it, don't repeat the list.

EVIDENCE
Call logs and screenshots saved to booking file: Y/N | Keep until: trip end + at least 2 years

A few lines matter most: the confirmation number must come from the hotel, not the portal's booking ID, which only proves the portal issued a voucher. "Paid or guaranteed" goes to the hotel or vehicle owner, since a booking can sit on a screen with no money behind it. "Will share later" on a driver is RED at T-72, and the evidence line exists because complaints land long after the trip.

Push the cost back up the chain: the back-to-back clause

Don't count on your client terms to shield you: the Delhi district order above rejected the "only a facilitator" defence. What you can do is make a handler pay you back.

The Contract Act defines indemnity as a promise to save the other party from loss caused by the promisor's own conduct or anyone else's (section 124), letting the holder recover damages it is compelled to pay in a suit, its costs, and sums paid in a prudent settlement (section 125). Section 125 speaks of a "suit", so the clause below names consumer commission orders expressly. Without a clause you are left with ordinary breach damages, which cover loss arising naturally from the breach but not "remote and indirect" loss (section 73).

Reconfirmation and no-show. [Handler] shall send the driver's name, mobile
number and vehicle registration number for every transfer at least 24 hours
before the service, track the arrival flight or train, and keep the driver
at the pickup point until the guests arrive, at no extra charge for delays
up to [N] hours. If any confirmed service is not provided, [Handler] shall
(a) refund its charge for that service, (b) pay the actual cost of
substitute services arranged by [Agency] or the guests, and (c) indemnify
[Agency] against all refunds, compensation and costs that [Agency] is
ordered to pay, or reasonably agrees to pay, to the guests in respect of
that failure, including under any order of a consumer commission or court.
[Agency] may set off these amounts against any sum payable to [Handler].

This holds only as well as the handler's solvency, the enforcing jurisdiction and its wording, and it does not reduce what you owe the client: get it lawyer-reviewed first. If your agency is a partnership firm, every partner is liable, jointly and severally, for the firm's acts (section 25 of the Partnership Act).

Keep the trail for two years

A complaint can be filed up to two years from when the cause of action arose, usually the trip, and later if the commission condones the delay (section 69). Save the sweep sheet, call logs and screenshots to the booking file, and respond within the time a commission gives, or it proceeds "ex parte on the basis of evidence brought to its notice by the complainant" alone (section 38).

Common questions

Hotel wale bol rahe hain booking nahi hai, voucher hai: ab kya karein?

Call the hotel's own reception, not the portal, for its confirmation number and the reservation name. No record: put it to the portal in writing, same day, with a deadline, and rebook direct if unresolved.

Driver nahi aaya airport pe: client ka cab ka paisa kaun dega?

Expect your agency to pay first and recover from the supplier later. In Rose Tour, the District Commission, upheld on appeal, said it was the agency's duty to make sure the clients got a taxi "even if the flight was late", since it had already charged for the service. Reimburse against a receipt, then claim it back under an indemnity clause if you have one.

How do I get a hotel confirmation number for a B2B portal booking?

Call or email the property directly with the guest name and dates, for its own confirmation number, separate from the portal's booking ID. There is no reliable rule for when a portal or bed bank passes a booking to the hotel, so make this call on every third-party booking.

The short version

  • A voucher proves you booked it; only a reconfirmation shows the room, car and driver will be there.
  • Run the T-72 sweep: hotel confirmation number from the property, payment status, driver details, services read back.
  • RED at T-72 gets fixed by T-48 or rebooked; the client is told now, not at the desk.
  • Night arrivals (21:00-06:00) get a written on-duty confirmation, live tracking, a landing call, and a fallback cab with a cap.
  • At T-24, send the client the HCN, driver details and fallback rule so they can verify independently.
  • Push the risk back with a written back-to-back indemnity clause, lawyer-reviewed before use.
  • Keep call logs and screenshots for at least two years; a commission that hears nothing from you decides on the client's version alone.
