AC in the hills, 8 pm cut-off: the cab terms clients must see
A copy-paste cab terms card for your tour quotes and vouchers: daily hours, AC on climbs, tolls, extra kilometres, and what the driver can't ask for.
Uluwatu · 18:25Your clients get into the cab expecting one trip. The driver is running a different one: AC off on the climb, no driving past a fixed hour, tolls not his to absorb. Nobody put these cab usage terms for the tour package in front of the family, so when the AC clicks off near Munnar, it reads as the cab cheating them, not a term nobody wrote down.
Say a Kerala FIT family calls from the roadside, AC off, driver unwilling to go out after 8 pm, asking for toll cash that was meant to be included. By the time you've calmed them, they've threatened a one-star review and a refund.
That fight is preventable: one vehicle terms card for every domestic quote and voucher, a matching copy for the driver, and scripts for when someone asks a client for money on the road.
Why the fight starts inside the vehicle
The transporter's terms reach the driver and almost never reach the client, so both act in good faith from two different rulebooks. Consumer law judges you against what you wrote: the Consumer Protection Act, 2019 gives every consumer the right to be informed of a service's standard (s.2(9)(ii)), and treats "deliberate withholding of relevant information" (s.2(11)(ii)) as a deficiency. "AC cab" sold without the ghat caveat can also read as falsely representing the service (s.2(47)(i)).
Two older orders (both under the 1986 Act) cut both ways: a receipt for an "A.C. Tempo Traveler" beat the operator's plea that the mini-bus it sent instead was a better vehicle in Rao Travels v Chitralekha (2009); a written programme the client had accepted won the case for the operator in Fantasy Travels (2016). Write the terms down, and they protect you too.
The terms that start roadside fights
| Term | Client assumes | What it usually means | Put this in writing |
|---|---|---|---|
| Disposal vs transfers | "Car is ours all day" | At-disposal covers the itinerary; transfers-only is pickup/drop | State which one, on the quote |
| Daily hours | "Car runs till we're done" | A fixed window applies (for example 8 am-8 pm); more costs extra | Name the window and after-hours rate |
| Kilometres | "Unlimited, it's a package" | A km cap applies, counted a fixed way | State km included and the basis |
| AC on climbs | "AC runs the whole trip" | Some transporters switch it off on steep gradients | Say plainly if AC may switch off, where |
| Tolls, parking, state tax | "Obviously included" | Only if the quote says so | Mark included or not, no middle ground |
| Local-taxi zones | "Same car everywhere" | Some hill towns reserve sightseeing for union taxis | Name the zone if you know one |
Hours: the only official timing we could verify is Uttarakhand's Char Dham advisory: no hill-route driving before 5 am or after 7 pm. It is Yatra advice, not a statewide ban. The eight-hour day under the OSH Code, 2020 covers only motor transport undertakings with ten or more workers, so many owner-driver cabs fall outside it.
Tolls: NHAI's FASTag Annual Pass (₹3,000 for base year 2025-26) is for private non-commercial cars only, so a tourist taxi can't use it. State tax: an All India Tourist Permit doesn't exempt a vehicle, and the Kerala High Court (2024), the Supreme Court (2024) and the Madras High Court (August 2026) have each declined to stop state levies, as of October 2026. Seats: the Motor Vehicles Act fines ₹200 per excess passenger (s.194A) and ₹1,000 for a child under 14 not secured by a seat belt or child restraint (s.194B); Ladakh's taxi union is the clearest zone barring outside vehicles from local sightseeing.
The vehicle card: copy-paste for quotes and vouchers
Put this on every domestic quote, in full on the voucher, filled in per booking:
YOUR VEHICLE: WHAT IS INCLUDED
Booking ref: [ ] Dates: [ ] to [ ]
Vehicle: [AC Innova Crysta] or another vehicle of the same seat count and
class, never smaller. Registration no. and driver name/mobile sent
[24 hours] before pickup.
Seats: [6] passengers including children, as per the vehicle's registration.
Luggage: [4 large + 4 small bags]. Children under 14 must wear a seat belt
or use a child seat (child seat only if booked).
How it is used: [At your disposal for the itinerary below] / [Transfers
only: airport to hotel and back].
Daily hours: [8:00 am to 8:00 pm]. Use after [8:00 pm] only if agreed with
us by [4 pm] the same day, at Rs [ ] per started hour, and only where the
driver's rest and local hill-road rules allow.
Kilometres: [1,000] km included for the whole trip, counted [garage to
garage from Kochi]. Extra km: Rs [ ] per km.
Sightseeing: the points listed day by day in your itinerary. Any extra
point or detour: we confirm the price on WhatsApp before you go.
AC: [Runs throughout.] OR [Runs on plains and city roads. On steep ghat
climbs ([Munnar, Thekkady]) the driver may switch it off during the climb
and back on after.]
Tolls, parking, state entry/border tax: [INCLUDED. Do not pay the driver
for these.] OR [NOT INCLUDED: paid at actuals against the receipt, settled
with us.]
Driver's allowance, food and stay: INCLUDED. Fuel: INCLUDED.
Local-taxi zones: at [place], only local taxis may run [points]; cost
[included / Rs __ / paid locally].
Breakdown: replacement vehicle within [4] hours at our cost.
Tips: optional, entirely your choice.
If the driver asks you for money for anything above, or refuses something
on this card: do not argue and do not pay. Call [name] on [24x7 mobile].
"Same class, never smaller" is a substitution clause, the logic behind the hotel "or similar" clause applied to a car. Base the hours and km figures on your own vehicle costing. The AC line does what the written programme did in Fantasy Travels: it fixes the promise before the climb, so "AC cab" can't be read as AC on every road.
"Do not pay the driver" stops cash changing hands at 9 pm. Tips stay "your choice" as a courtesy; the nearest ruling, a 2025 Delhi High Court judgment upholding CCPA's service-charge guidelines, covers hotels and restaurants, not drivers.
The driver's copy: same card, his language
Send this to the transporter 24-48 hours before pickup, and ask for a reply confirming the driver has it:
Guest ke paas yahi card hai. Card mein jo included hai uske liye guest se
paise nahi lena. Koi extra point ya extra time ho to pehle office ko call
karo, guest se rate mat bolo.
AC: [poore trip chalega / sirf ghat chadhai par band, uske baad on].
Raat [7/8] baje ke baad hill road par nahi chalana.
Toll/parking ka receipt sambhal ke rakhna, hamare saath settle hoga.
This is proof, not politeness: the driver can't claim the client agreed to something else.
When the driver asks for money on the road
The CCPA's dark-patterns guidelines (2023) define "drip pricing" to include price elements not revealed upfront and a paid-for service withheld unless something extra is bought. They apply to platforms, advertisers and sellers, not roadside drivers, but it's the exact shape of this complaint. Use these in order:
CLIENT, ON WHATSAPP OR CALL
"Thank you for telling us. Please don't pay anything, tolls are included
as per your vehicle card. I'm calling the transport office now and will
call you back in 15 minutes. If he insists, put him on the phone with me."
AGENT TO TRANSPORTER
"Your driver on [vehicle no.] is asking our guest for [toll/parking/
after-hours] money. Our booking says this is included. Please call him
now and confirm to me in 10 minutes. Anything he has paid comes on your
bill to us with receipts, not from the guest."
AFTER-TRIP SETTLEMENT (within 48 hours of return)
One message to the client listing any extras agreed on WhatsApp (date,
item, amount), the total, confirming nothing else is payable. One
settlement with the transporter against receipts and the closing odometer.
Worked example: extra hours and extra kilometres, settled
Illustrative numbers, not market rates: a hypothetical five-night Kerala FIT, family of four.
Example: Card says 1,000 km included, extra km at an illustrative ₹14, extra hours at an illustrative ₹250 per started hour past 8 pm. The family stays out for a show one evening and the car is released at 9:15 pm, 2 started hours past 8 pm. They also ask for two unlisted stops adding 65 km, agreed on WhatsApp first; a road diversion adds 20 km nobody asked for. Closing odometer: 1,085 km against 1,000.
Extra km is 85. The 65 client-requested km (₹910) and 2 extra hours (₹500) total ₹1,410, which the client pays, settled with the agency. The 20 diversion km, ₹280, is the agency's cost, since it was the sold route. Tolls and state tax stay at zero to the client, since the card marked them included.
Common questions
Hill station me AC kyu band kar dete hain?
Some transporters keep the AC off on steep ghat climbs. One Kerala operator's 2026 guide says AC is generally disabled in Munnar, Wayanad and Thekkady because steep gradients overheat the engine. That is a transporter's practice and reasoning, not a law, which is why it belongs on your card.
Are tolls and parking included in a tour package cab?
Only if your card or voucher says so. A tourist taxi can't use the FASTag Annual Pass, which is for private non-commercial cars, and a client's pass on their own car doesn't transfer to a hired vehicle.
Driver 8 baje ke baad gaadi nahi chalayega, kya ye sahi hai?
Usually a commercial daily-hours window, not a statewide ban. The only official timing we could verify is Uttarakhand's Char Dham advisory: no hill-route driving before 5 am or after 7 pm, written for the Yatra.
Who pays state entry tax for an outstation tourist taxi?
Whoever your card or quote says pays it. An All India Tourist Permit doesn't exempt a vehicle from a state's entry/border tax, and courts have so far declined to stop states collecting; in 2024 the Supreme Court sent the challenges to the High Courts.
The short version
- Most fights happen because the transporter's terms reach the driver, never the client. Write them down once, on one card, for both.
- AC switching off on a ghat climb is a transporter practice that varies, not law; say so on the card instead of leaving "AC cab" unqualified.
- Name the daily-hours window, km included and the counting basis on the quote; the only official timing we could verify is Uttarakhand's Char Dham advisory, and it is written for the Yatra.
- Mark tolls, parking and state entry/border tax included or not, with no in-between; courts have not stopped states taxing tourist-permit vehicles, as of October 2026.
- "Do not pay the driver for anything on this card" stops roadside cash demands, backed by a 15-minute call-back promise.
- Send the driver the same card 24-48 hours before pickup and get a confirmation reply; price every genuine extra on WhatsApp first, and settle within 48 hours, not on a hill road.
